In the last few years case law has played a huge part in determining what should be included in the Holiday Pay calculation. The most recent case, Harpur Trust v Brazel, confirmed holiday leave rights for casual workers / zero-hour contracts.
The government has responded to the consultations issued in 2023, and draft legislation confirms the 12.07% can be used for casual workers / zero-hour contracts, for both calculating entitlement and rolled up holiday. However, what about full time and part time workers? How do we calculate their ‘normal’ pay? And what impact will the latest Supreme Court decision in the Chief Constable of the Police Service of Northern Ireland v Agnew case, have on employers?
