Essential Guide to the SMCR Conduct Rules for Employees at FCA-authorised Firms

The new FCA Conduct Rules set basic standards of good personal behaviour for all staff at FCA authorised firms. They have been designed to ensure that the FCA can hold everyone who works in financial services personally accountable and responsible for their actions.By 9 December 2019, firms must have trained their senior managers and certification staff on the Conduct Rules that apply to them. Firms must train all of their other staff on the Conduct Rules that apply to them by 9 December 2020.

Suitability - Who should attend?

No prior knowledge of the Conduct Rules is assumed.DelegatesThis course is appropriate for:All staff at FCA-authorised firms; andLegal advisers to FCA-authorised firms (no minimum PQE required).

Outcome / Qualification etc.

The course will analyse the practical implications of those Conduct Rules that apply to all staff at FCA-authorised firms - the ‘Individual Conduct Rules’.The Individual Conduct Rules require staff to:Act with integrity Act with due care, skill and diligenceBe open and cooperative with regulatorsPay due regard to the interests of customers and treat them fairlyObserve proper standards of market conductDelegates will be equipped to:Recognise situations in which the Individual Conduct Rules would be engaged; andAvoid breaching the Individual Conduct Rules.The course will examine FCA guidance on the Individual Conduct Rules. FCA disciplinary proceedings against individuals will be used as case studies on poor conduct.Delegates will put all of these learnings into practice by working through a series of scenarios in teams throughout the day.
