Course description

Overview

This course is recommended for all litigation practitioners, as it provides an issue-based approach which is not only logical, but a highly functional guide to handling all types of litigation effectively.

It gives a broad overview of the management of a commercial claim, with a practical case study running throughout. This will embed the learning and provide a practical application in this evolving area of practice


Who is this for?

This course is for practitioners who are new to commercial litigation or are returning to it. It’s suitable for trainee and newly qualified solicitors, legal executives and paralegals.

Although the focus of this course is on the operation of the Commercial Court and the Circuit Commercial Court (within the Business & Property Courts), it is recommended for all litigation practitioners.


What will you learn?

The issue-based approach taken by the Commercial Court and the Circuit Commercial Court provides a logical and highly functional guide to handling all types of litigation effectively.

You’ll gain practical experience of identifying and agreeing issues, analysing evidence and conducting settlement discussions based around those issues.

By the end of the course, you’ll have a strong understanding of all of the following:

  • The structure and choice of Court
  • The procedural framework of the CPR, the Admiralty & Commercial Court Guide, the Circuit Commercial Court Guides and relevant Practice Directions
  • Commencement, Statements of Case, Evidence and ADR (including Early Neutral Evaluation)
  • Identification of common ground and issues through a practical case study exercise 'acting' for either Claimant or Defendant
  • Key features of case management including consideration of the Shorter and Flexible Trial Schemes; Designated Judges, fixing and handling a CMC
  • Analysis of evidence and conducting settlement discussions
  • Ordinary and heavy applications in commercial litigation (on and without notice)
