Course description
Overview
The course will provide you with a solid understanding of the practical and legal issues to be considered when taking security, from both the lender’s and borrower’s viewpoint. Using case studies and practical examples it will also familiarise you with the commercial terminology used in the market.

This course will be of benefit to all practitioners who are new to finance and banking law, as well as junior corporate and property lawyers and those requiring a refresher in the area of law.

- Identify the main issues for companies when granting security
- Describe the different types of legal and quasi security (including applicable legislation and case law), and the most appropriate security for different types of assets
- Understand the key provisions of debentures, guarantees and inter creditor deeds
- Define the issues when negotiating security documents
- Recognise the importance of perfection and priority of security
- Explain the procedures and tensions when seeking to enforce security
- Identify the additional complexities of granting cross-border security
- Assess recent trends such as debt buy backs by borrowers
PSC Elective
This course may be taken as a PSC elective, although it may also be attended by non-trainees.
