IP is often overlooked in insolvency processes and those involved may not realise the full value of the assets they are selling or purchasing. To advise clients, it is crucial to identify IP rights, both registered and unregistered, check ownership and carry out an assessment of value. It can also be attractive to revive an older brand that has seemingly been abandoned, which saves on time and marketing efforts by building off a past reputation.
However, some rights can still exist, or the original brand owner may still retain an interest in the brand, which can prevent a new owner from making use of the so-called ‘zombie’ trade mark.
