Course description

The Untraced Drivers Agreement 2017 addresses the scenario where an injured person cannot identify the ‘at fault driver’, commonly known as a ‘hit and run’, and governs their right to compensation.


However with these types of claims, unlike claims against uninsured drivers, the relevant court proceedings cannot be issued and the MIB cannot be joined into the claim if an agreement cannot be reached so the matter often proceeds to arbitration. It is therefore vital that you can rely on a detailed knowledge of serious injury claims where there is an untraced driver.

Introduction

The Untraced Drivers Agreement 2017 applies to all accidents after 1 March 2017 and sets out the specific procedure which must be followed to make a claim. Where an injured person cannot identify the ‘at fault driver’ of a vehicle, the classic ‘hit and run’ scenario, this is the agreement which governs their right to compensation.

Unlike a claim against an uninsured driver where, if agreement cannot be reached, a Claimant can issue court proceedings and join the MIB into the claim, under the Untraced Drivers Agreement 2017 Court proceedings cannot be issued and if the parties cannot reach agreement the matter proceeds to arbitration.
