Course description

Directed by Steven Walker and Iain Clark

This 5-day conference on International Arbitration in the oil, gas and minerals industry is intended to be of interest to lawyers and non-lawyers alike. The conference will provide perspectives from legal experts, trial and in-house counsel, international arbitrators, and academics.

The conference is structured to include presentations by some of the leading practitioners in the industry (including a number of guest speakers throughout the event), as well as offering a number of practical training sessions on written and oral advocacy skills in the conduct of international arbitrations, culminating in the preparation and conduct of a mock arbitration, where delegates will have the opportunity to learn by doing!

Of particular interest to delegates will be a full day devoted to Investor-State (or Investment) Arbitration, including presentations on The investor-state arbitral framework; Jurisdictional requirements and the requirement of consent – BITs, MITs, arbitration agreements, investment laws; Procedural issues, the role of arbitrators; Substantive protections and guarantees available to investors and state responsibility – fair and equitable treatment; Failure to protect, expropriation, state-owned enterprises; and Award enforcement.
