Course description
Presented by Hannah Mackinlay, this 6-part modular webinar series for commercial property support staff will look at the key concepts and provide practical advice for paralegals, assistants and those new to commercial property.
Module 1 will begin by exploring what commercial property is and the key differences between commercial and residential, followed by Module 2 which will explore the process involved (including AML, searches, Companies House registration and more). Module 3 will cover planning law and infrastructure, followed by Module 4 which will discuss property development (including the concepts behind options, overage, conditional contracts and more). Module 5 will dig deep into commercial leases, and Module 6 will round off the series with a discussion on key tax issues including SDLT, VAT and capital allowances.

The planning position is often more complex with commercial property; this module will look at:
- Basic structure of planning law

- Enforcement of planning breaches
- The use classes & permitted development
Module 4 - Property Development
Much of commercial property involves development of land for sale as dwellings or commercial office/industrial/warehousing. This module will explain the basic concepts behind:
- Options
- Conditional contracts
- Overage
- Land promotion agreements
- Auctions
Module 5 - Commercial Leases
- The code for commercial leases
- Structure of a rack rent lease
- The key issues - demised premises, rights granted, repairing obligations, insurance obligations, break clauses
- Control over assignments and underlettings
- Security of tenure
Module 6 - Key Tax Issues
This module will give an overview of the key tax issues, rarely applicable to residential property:
- VAT
- SDLT
- Capital allowances
