The law in this area is swiftly developing but issues remain uncertain. The legal status of cryptoassets is not well-defined in English law with no legislation in in place, and cryptoassets not being currently regulated by the Financial Conduct Authority.
The English courts have generally been quick to address issues as they arise to ensure that the common law serves litigants.
As a result, there is a growing body of case law of which all litigants need to be aware.
