There has been a marked increase in the use of bikes and scooters in recent years, in part due to the introduction of electric versions of each, and this has drawn attention to the argument surrounding whether failure to wear a helmet can result in a finding of contributory negligence.
Barrister Colm Nugent presents this live and interactive broadcast which will review the current law, with consideration given to comparative jurisdictions, to arm you with the information to argue contributory fault and causation effectively and knowledgeably. It will also cover the evidential development of experts being able to assess the likelihood of brain injury where a helmet is involved.

Introduction
The post-pandemic rise in cycling since 2020, and the introduction of electric bikes and scooters to our towns and cities has given added impetus to the on-going argument about the extent to which a failure to wear a helmet can result in a finding of contributory negligence.
This virtual classroom seminar reviews the current law (and relevant cases), considers comparative jurisdictions and arms you with the information to argue contributory fault and causation effectively and knowledgeably.
But cycle helmet arguments are no longer the preserve only of defendants. Recent developments in testing technology has resulted in the ability for experts to opine on the forces involved in head injuries where a helmet is involved and assist the neurologists and other experts to take a more informed view on the likelihood and severity of brain injury. This live session also highlights this evidential development and how it may be used to advance your case.
What You Will Learn
This live and interactive session will cover the following:
- An update on cycle-helmet cases in the courts - here and in comparable jurisdictions
- The key issues in cycle helmet cases
- Cycle helmets and contributory fault
- Neurologists and cycle helmets
- How cycle helmet expert evidence can help prove or disprove the likelihood of brain injury
