Practitioners will be aware that the court must look beyond strictly property assets, businesses and bank accounts and consider ‘other financial resources which each of the parties to the marriage has or is likely to have in the foreseeable future’ (section 25(2)(a), Matrimonial Causes Act 1973 (MCA 1973)).
Trusts can come in a variety of forms and this virtual classroom seminar will consider these and the fact that they can often contain funds that may originate outside a marriage.
