Introduction

The landscape of will writing and LPA preparation is ever changing, and recent developments mean that practitioners will need to be aware of the do’s and don’ts in drafting.

For example, electronic assets and the use of electronic witnessing have changed the landscape of wills for the long term.

Co-habiting couples, second marriages and children from former marriages can cause problems both in will writing and in the management of assets for a donor lacking capacity, and often the practitioner can end up in the middle of a dispute.

Lasting Powers of Attorney are regularly made by individuals without using solicitors but often we become involved when things go wrong!
