This introductory level webinar will raise awareness of the scope of powers and duties of an attorney or deputy, focusing on their limitations and the financial decisions which they should not make without seeking the Court of Protection’s approval. Specifically, the webinar will focus on the making of substantial gifts from P’s estate.

Introduction

Over the last few years, the OPG has received many concerns and complaints regarding actions taken by attorneys and deputies, particularly in respect of the management of a protected person’s property and affairs.

This introductory level webinar will raise awareness of the scope of powers and duties of an attorney or deputy and the decisions which they can make on behalf of P. More importantly, the focus will be on their limitations and the financial decisions which they should not make without seeking the Court of Protection’s approval in the first instance.

Specifically, the webinar will focus on the making of substantial gifts from P’s estate and is aimed at solicitors or private client professionals who advise attorneys and deputies on the scope of their powers and those who make applications to the Court of Protection.

What You Will Learn

This webinar will cover the following:

  • The scope of an attorney’s/deputy’s powers when it comes to gifting
  • Current legislation and caselaw, including PBC v JMA
  • What is considered a substantial gift?
  • When an attorney should consider making an application to the Court of Protection and the process involved
