Course description
Pre and post nuptial/civil partnership agreements are still often seen as only for the rich and famous. But they can be really useful for many clients, helping to avoid uncertainty, stress and cost in the event of future separation. Practitioners can feel apprehensive about them (not unreasonably given the repercussions of getting them wrong).
Presented by Jenny Smith, a partner at Harper Macleod LLP, this virtual classroom seminar will explore the purpose and benefits of such agreements, what to discuss with your client when advising them, and how to draft the agreement. How to revise the agreement (when it has been prepared by the other lawyer) will also be discussed, along with how to deal with the sensitive and emotive aspects of this topic, pitfalls and challenges to be aware of, and a review/update of relevant caselaw.
