The Act gives flat leaseholders - in mixed commercial/residential buildings as well as in blocks of flats - rights of pre-emption. So, where the immediate landlord proposes to dispose of an interest in such a building it may first have to offer the disposal to the residential tenants.

So, where the immediate landlord proposes to dispose of an interest in such a building it may first have to offer the disposal to the residential tenants. Breach of the Act is not only a criminal offence for the landlord but gives the flat leaseholders rights to take the disposal from the purchaser for the price it paid.
