Mental Health in the Workplace: Prevention, Management & Risks

Mental health issues at work cost UK employers billions every year in due to sickness absence and management time. This course will help you understand how to recognise the signs and help your clients identify areas of risk. You will learn how to proactively and effectively manage mental health-related absence, either facilitating a return to work or dismissing fairly. You will understand mental health as a disability and what claims employees may bring whether they remain at work or not.

Mental health issues in the workplace are increasing rapidly, costing employers billions of pounds every year in lost productivity and management time. This course is designed to enable delegates to learn how to recognise signs of mental health issues and identify areas of risk, understand how to manage employees that go off sick with mental health issues, how to facilitate a return to work or manage dismissals fairly, and to understand what claims may be brought against employers.

Suitability - Who should attend?

This course has been designed for trainee and qualified lawyers (0-5 pqe) or those without sufficient experience of advising on mental health.

Training Course Content

  • What are the commonly arising mental health issues, how common are they and who is most at risk?
  • What is the employer’s duty of care and the legal framework (including obligations under the Health & Safety at Work Act and under UK employment law)
  • What can contribute to mental health issues in the workplace, how can we spot them and what preventative measures can we take to minimise the risk of this happening?
  • How to manage employees who go off sick with mental health issues
  • When mental health issues become a disability: understanding where adjustments may need to be made in the workplace and how to make them
  • Managing return to work or terminating employment
  • Understanding the claims that someone may bring as a result of their mental health issues (unfair dismissal, personal injury claims arising from common law negligence, breach of contract claims, disability discrimination claims)
