Lasting Powers of Attorney (‘LPAs’) are traditionally used as a way of planning for what happens if someone loses capacity or is otherwise unable to make a decision for themselves. An element of preparing an LPA is to find a suitable person to act as a certificate provider.

Lasting Powers of Attorney (‘LPAs’) are traditionally used as a way of planning for what happens if someone loses capacity or is otherwise unable to make a decision for themselves.

Preparing an LPA for someone’s business affairs is a sensible precaution to safeguard the client and the business’ interests.

An element of preparing an LPA is to find a suitable person to act as a certificate provider.

This is an important step for an LPA and the instrument could be invalid if not done properly.

If a person loses capacity without a properly executed LPA, an application to the Court of Protection for the appointment of a deputy may be necessary, which can be expensive and time consuming.

If an LPA instrument has been incorrectly drafted, it may not confer any authority on the proposed attorneys and can be very expensive to rectify.
