Course description

Whilst other sectors of law have suffered throughout the current economic climate, the private client sector has continued to grow at a rapid pace.


Wills are in high demand, care fees and tax planning are becoming commonplace, and one in four estates are now contested. The result of this is that many people are converting into this sector, not only as newly qualified solicitors, trainees, and paralegals, but also solicitors from other disciplines.


Presented by the hugely popular speaker Helen Forster, this virtual classroom seminar is designed to give you the foundations to work in this area and will be split into two distinct training days. Day 1 will cover wills, will drafting and will validity, while day 2 will explore probate, inheritance tax, and administration of an estate.

What You Will Learn

This live and interactive session will cover the following:

Day 1 - Wills, Will Drafting & Will Validity

  • Terminology, the basic requirements, and formal validity of wills
  • Inheritance tax
  • Drafting a will - standard clauses, ‘simple’ wills, life interest wills, discretionary trust wills and the 2-year rule
  • Revocation and alteration of a will
  • Alterations to a will
  • Beneficiaries - identification, unknown and missing beneficiaries
  • Survivorship clauses and forfeiture
  • Larke v Nugus requests and release of documentation

Day 2 - Probate, Inheritance Tax & Administration of an Estate

  • What is probate?
  • Ascertaining assets/liabilities
  • Inheritance tax, nil rate bands and the residence nil rate band
  • Potentially exempt transfers and the backwards shadow
  • Gifts with reservation of benefit and preowned asset tax
  • Trusts and their treatment in respect of the deceased's estate
  • Applying reliefs - quick succession, BPR, APR and gifts out of income
  • The procedure for applying for probate
  • Capital gains tax and income tax and when they apply to an estate - do you need a tax return?
  • Missing beneficiaries and claims against an estate
  • Completing an administration
