Course description

Wills and probate are one of the few areas of law which nearly all members of the public will require at some point.


The result of this is that many people are converting into this sector, not only as newly qualified solicitors, trainees, and paralegals, but also solicitors from other disciplines.


This full day course assumes no prior knowledge and will provide an excellent introduction to this interesting area of law with numerous practical examples to assist with learning. There will be a focus on all the terminology used in this area, with clear explanations as to what these words and phrases mean.

What You Will Learn

This course will cover the following:

  • Wills - the basic requirements and formal validity of wills
  • Revocation and alteration of a wills
  • Beneficiaries - identification, unknown and missing beneficiaries
  • Larke v Nugus requests and release of documentation
  • What is probate?
  • Ascertaining assets/liabilities
  • Inheritance tax, nil rate bands and the residence nil rate band
  • Trusts and their treatment in respect of the deceased's estate
  • Applying reliefs - quick succession, Business Relief (‘BR’), Agricultural Relief (‘AR’) and gifts out of income
  • The procedure for applying for probate
  • Capital gains tax and income tax and when they apply to an estate - do you need a tax return?
  • Missing beneficiaries and claims against an estate
