This increase in emphasis on ESG credentials has not only brought such matters further up the agendas of businesses and their stakeholders but has also led to increased scrutiny by regulators and prosecutors with suggestions that 2022 saw investigations and enforcement in the envinmental, social and governance (ESG) space hit an all-time high.

Enforcement action has particularly focused on variants of greenwashing including misrepresentations and omissions in corporate communications. In addition there have been a number of notable cases brought by NGOs looking for new and innovative ways to hold businesses to account.

The pandemic, the invasion of Ukraine and growing awareness of the climate emergency have all contributed to an increased emphasis on ESG credentials in business.

This increase in emphasis has not only brought ESG matters further up the agendas of businesses and their stakeholders but has also led to increased scrutiny by regulators and prosecutors with suggestions that 2022 saw investigations and enforcement in the environmental, social and governance (ESG) space hit an all-time high.

Whilst there were many different variants of ESG related litigation and enforcement in 2022, enforcement action has particularly focused on variants of greenwashing including misrepresentations and omissions in corporate communications.

In addition there have been a number of notable cases brought by non-governmental organisations (NGOs) looking for new and innovative ways to hold businesses to account. Against this background this webinar considers how to engage with regulators active in the ESG space.
