In modern times, it remains the case that there is little stigma attached to an adverse finding of breach of contract or unfair dismissal against an employer. Indeed, even with the publication of all Employment Tribunal judgments online (as a matter of public record), most employers are happy to stomach such a finding.
In discrimination cases, however, the position is quite different. If an employer contests a discrimination case without settling it and subsequently loses, the adverse findings can have serious implications.
