An office holder’s powers of investigation can be the gateway to recoveries in any insolvency appointment. It is therefore critical that an office holder is both aware of the powers they have and can use those powers appropriately.


Presented by expert speaker Craig Parrett, this virtual classroom seminar will offer a practical approach to investigations and the utilisation of office holders’ powers and offer tips on how to use the sources of information and powers available to obtain the best result for creditors.


Craig is a Senior Associate at Isadore Goldman and works primarily on the full range of insolvency and restructuring matters from both a corporate and personal insolvency perspective.

Introduction

An office holder’s powers of investigation can be the gateway to recoveries in any insolvency appointment and it is therefore critical that an office holder is both aware of the powers they have and can use those powers appropriately.

The office holders’ powers of compulsion are set out in the Insolvency Act, but this is only half of the story.

Before utilising those powers, the office holder must consider what information they need in each specific case.

This new virtual classroom seminar will offer a practical approach to investigations and the utilisation of office holders’ powers and offer tips on how to use the sources of information and powers available to obtain the best result for creditors.

This live and interactive course will cover the following:

  • The office holder’s statutory powers of investigation in the Insolvency Act for both liquidations and bankruptcies
  • Case law relating to the exercise of those powers
  • The limits on the statutory powers
  • Conduct of a private examination and what might happen after an application is made to Court
  • Who is liable for the costs of such an application and for the provision of information?
  • The sources of potential information, including how to find out information quickly and easily from freely available sources online
