This course unravels and reveals the unwritten rules, good practice, procedures, potential pitfalls and tactics necessary to manage cases effectively.

Focusing heavily on practical case study exercises, we will acquaint you with the practical reality of bringing and defending claims in the employment tribunal system.

This course will be of benefit to legal practitioners, in-house legal advisors, managers or HR professionals, who wish to get to grips with employment tribunal work on behalf of Claimants or Respondents..

What will you learn?

  • Appreciate the significance of the Overriding Objective in all aspects of employment tribunal work
  • Carry out basic analysis of a party’s case or defence – can a Claimant win or a Respondent defend successfully?
  • Comply with appropriate time limits, taking into account ACAS Early Conciliation and the different tests to apply
  • Appreciate the purpose and format of the Claim Form (ET1) and Response Form (ET3)
  • Understand the typical procedural steps a case will take from instigation to conclusion and prepare a basic case plan
  • Identify relevant information, documentation and witness evidence in relation to a case
  • Consider opportunities for negotiation, settlement and withdrawal of a case(including a basic understanding of Judicial Mediation and Judicial Assessment)

This course may be taken as a PSC elective, although it may also be attended by non-trainees.
