Course description

Overview

The course gives a full overview of the law and procedure relating to claims for a financial order on and after divorce. It covers all aspects of a case from first instructions to final order. At the end of the course that you will have increased confidence about how to apply for a financial order and to prepare for and present hearings.

This course will be of benefit to Chartered Legal Executives, Solicitors, Trainee Solicitors, and support staff. This course will be of benefit to advisers who are new to, or are unsure about, this area of law. It will also benefit returners to family law with an update on current law and practice.

Topics covered include:

  • Consideration of the PreAction Steps
  • Financial Orders – Law and Procedure
  • Consideration of the various forms in a Financial Order Application
  • Consideration of the Various Orders
  • Application of the Statutory Criteria
  • Consideration of Developing Case Law
  • Consideration of the Various Hearings

By the end of this course, you will be able to;

  • Apply the Pre-Action Protocol and know when to challenge a breach by another party
  • Issue proceedings
  • Understanding the different type of orders available
  • Applying the criteria to low, average and high net cases
  • Prepare the Key Forms, including the Form E (Financial Statement), Statement of Issues, and Questionnaires, so as to provide and obtain proper disclosure
  • Attend a First Appointment and seek appropriate directions
  • Advise a client at Financial Dispute Resolution (FDR) on the best realistic terms of settlement
  • Apply for Interim Orders needed to protect your client’s position
  • Use the statutory ‘guidelines’ so as to predict the likely outcome of a trial
  • Prepare for an effective Final Hearing

PSC Elective

This course may be undertaken as a PSC elective, although it may also be attended by non-trainees.
