TUPE: Transfer of Undertakings - 2 day Course

TUPE, or Transfer of Undertakings (Protection of Employment) Regulations are an important part of the UK labour law, as they protect employees whose business is being transferred to another business. This two day course from CIPD will provide an opportunity to review the regulations on the transfers of undertakings, and then practically apply them.

Participants will learn HR practice, and how to develop legally compliant strategies which will deal with transfers. In addition, a case study of an organisation involved in TUPE will be used to ensure that legal framework and HR issues in business transfers will be understood. 

By the end of this course, you'll be able to:

    • advise on and apply the key legal principles covered by TUPE
    • manage a business transfer effectively
    • promote HR best practice.

    Suitability - Who should attend?

    HR practitioners who are responsible for employment law issues within their organisation’s policies and procedures, and those wishing to enhance their existing skills and knowledge. Some prior knowledge of TUPE is assumed.

    • When does TUPE apply?
      - the TUPE Regulations 2006
      - distinguishing between share acquisition and business transfers
      - relevant factors to be taken into account
      - the position of outsourcing and service transfers
      - recent cases.
    • Service provision changes
      - definition
      - organised grouping of employees.
    • Who is covered?
      - who transfers by TUPE
      - individuals employed by third parties
      - the right to object to a transfer
      - practical considerations.
    • What is transferred?
      - rights and liabilities that transfer
      - liabilities that do not transfer
      - bonuses and other benefits
      - restrictive covenants
      - new rules for occupational pension schemes.
    • The duty to inform and consult appropriate representatives
      - key TUPE provisions on collective rights
      - information to be provided
      - timing and practical considerations
      - identifying ‘measures’ which are envisaged
      - employee representatives
      - what does consultation involve?
      - the remedy for failure to inform and consult.
    • Dismissals
      - legal implications
      - automatically unfair dismissal
      - the ETO defence
      - practical considerations.
    • Changing terms and conditions
      - legal implications
      - ETO reasons
      - practical considerations.
    • Managing the change process – communication and the media.
