Course description
This virtual classroom seminar will explore the inter-play between the three methods of acquiring an easement by prescription (common law, lost modern grant and the Prescription Act 1832), the time during which the right must have been enjoyed and the quality of enjoyment which is required.
It will also address common defences to claims for prescriptive rights including that the enjoyment of the right was under protest or by licence or consent.
