Introduction

The regulatory frameworks for payment services in the EU and UK are undergoing major reforms, which will affect firms across the sector.

The EU is combining and updating its key Directives governing payment services and electronic money and the UK is reviewing its national legislation through which those EU Directives were transposed in the UK before Brexit.

Both sets of proposals include reforms relating to anti-fraud protections, safeguarding of customer funds, open banking, strong customer authentication and conduct of business requirements.

However, there are significant questions around the extent to which the UK will diverge from the EU and what that could mean for firms with cross-border businesses.

The UK and EU are also both creating and expanding regulation of cryptoassets in ways that will impact the payments sector.

The categories of cryptoassets and digital tokens, as well as the range of related activities, that will become subject to regulation are being extended significantly under the EU Markets in Cryptoassets (MiCA) Regulation and the UK’s proposals to regulate stablecoins, digital settlement assets and other cryptoassets.

Both sets of reforms will also create broad and detailed ongoing regulatory requirements for firms issuing cryptoassets or providing related services, such as exchanges and wallet providers.
